The present writ petition is filed seeking a direction to the second respondent to investigate into Crime No.82 of 2019 dated 03.08.2019 registered for the offences under Sections 427, 447 and 504 read with Section 34 IPC.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on written instructions, dated 25.10.2019, which is placed on record of this Court, would submit that on receipt of the complaint, dated 03.08.2019, made by the petitioner before the second respondent, a case was registered in Crime No.82 of 2019 for the offences under Sections 427, 447 and 504 read with Section 34 IPC on the same day itself and conducted enquiry. During the course of investigation, the second respondent examined L.Ws.1 to 5 and recorded their statements, apart from visiting the scene of offence and preparing the scene of offence panchanama, and obtained report from the Tahsildar, Nagaram, regarding pattadar and possessor of the subject land. Learned Assistant Government Pleader would further submit that investigation in the matter is completed, and after serving notice under Section 41-A Cr.P.C. to the accused, a final report would be filed before the Court concerned.

This Court has no reason to doubt the submission made on behalf of the second respondent that the matter would be investigated and in

case any offence is made out, the accused will be brought to the Court in accordance with law at the earliest.

The writ petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
