ORDER:

This Writ Petition is filed for a mandamus to set-aside proceedings in Rc.No.94/2008C, dated 10-4-2008 of respondent No.1 whereby he has suspended the petitioner's fair price shop authorisation.

A perusal of the impugned order shows that respondent No.1 has not limited the period of suspension to 90 days. As respondent No.1 was empowered to suspend the authorizations of fair price shop dealers only for a period of not exceeding 90 days, on this ground alone, the impugned order is liable to be set-aside. At any rate, by efflux of time, the impugned order has died its natural death. In this view of the matter, the Writ Petition is allowed.

As a sequel to the disposal of the Writ Petition, WPMP No.7464 of 2009 is disposed of.
