Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The petitioner complains of deletion of his name in the revenue records with regard to land admeasuring Ac.051 cents in Survey No.667/A3/A4 and Ac.1.45 cents in Survey No.667/A3 of Padamatipalem Village, Sangam Mandal, SPSR Nellore District. The petitioner has already filed a suit in O.S.No.138 of 2015 before the Principal Junior Civil Judge, Kovvur against the 4th respondent. He alleges that after filing of the said suit, his name was deleted from the revenue records by the 3rd respondent without any notice. Thereupon, he gave a legal notice on 19.10.2015 to the 3rd respondent. Alleging that no action is taken by the 3rd respondent, the present writ petition is filed. However, it is evident from the record that the petitioner has not made any proper application before the 3rd respondent for erroneous deletion of his name in the revenue records.

Unless the petitioner makes a proper application, the 3rd respondent as a recording authority under A.P. Rights in Land and Pattedar Passbooks Act cannot issue any proceedings. Hence, with a liberty to the petitioner to make a proper application before the 3rd respondent, the writ petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
