ORAL ORDER:

Heard learned counsel for petitioners and learned Government Pleader for Revenue.

Petitioners claim that they are owners and possessors of land to an extent of Ac.1.26 guntas in survey No. 435 and Ac.2.10 guntas in Survey No. 436, Mangalpally village, Ibrahimpatnam mandal, Ranga Reddy district. Out of the said property, petitioners 1 and 2 own Ac.0.33 guntas each in Survey No.435 and Ac.1.5 guntas each in Survey No. 436. After transfer of their names in revenue records, pattadar pass books and title deeds are issued to their respective shares. That being so, petitioners applied for conducting of survey. In response to the application made by petitioners, they were informed by memo dated 28.8.2019 that part survey number cannot be surveyed. It appears petitioners submitted another application on 3.9.2019 to conduct survey. 3.

Learned counsel for petitioners, though sought to contend that there is no bar to conduct part survey and objection raised by respondents is not valid and also sought to contend that neighbors to whom notices were issued are not cooperating, therefore survey could not be conducted, he would further submit that petitioners will supplement the application already made by them requesting to conduct survey for the two survey numbers in which their extent of land is available and on making such request, Tahsildar may be directed to conduct survey as per the application already made. 4.

In view of the above submission, without going into the merits of the writ petition, writ petition is disposed of granting liberty to

the petitioners to make an additional application requesting the Tahsildar-third respondent to conduct survey of entire extent of land in survey Nos. 435 and 436, Mangalpally village, Ibrahimpatnam mandal, Ranga Reddy district. On receipt of such request in terms of earlier application made by petitioners, survey shall be conducted in the presence of petitioners by issuing advance notices to all concerned persons including petitioners. Since the matter is pending for long time, expeditious steps shall be taken for conducting survey and preferably same shall be completed within a period of four weeks from the date of submission of additional application by petitioners furnishing all the details after putting all land owners/occupiers on notice. Accordingly, writ petition is disposed of.

Miscellaneous petitions, if any pending, are closed.
