THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No. 3548 of 2016 ORDER:- Alleging inaction on the part of the third respondent in not disposing of the appeal filed by the petitioner bearing No.B2/3867/2011, the present writ petition is filed.

Learned counsel for the petitioner states that the private party respondents in the appeal are already served and they have engaged a counsel on their behalf. Learned Government Pleader has confirmed the pendency of the appeal.

In view of the pendency of the appeal, I deem it appropriate to dispose of the writ petition directing the third respondent to fix a date for hearing in the said appeal by issuing notice to all the parties, hear the parties on the date so fixed, and dispose of the appeal preferably within two months from the date of receipt of a copy of this order. With the above direction, writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
