HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 40155 of 2012 ORDER:

Heard learned counsel for the petitioner and Government Pleader for Assignment. With the consent of both the parties, the main writ petition is heard at the admission stage itself.

The present writ petition came to be filed seeking issuance of writ of mandamus directing the official respondents to initiate action under Section 4 of the Andhra Pradesh Assigned Lands (Prohibition of Transfer) Act, 1977 against respondent No.5 and to restore the assigned lands to the petitioner in respect of file bearing No.78/1414 in Sy.No.735 admeasuring Ac.3.00 of Chilakamarri Village, Ananthasagaram Mandal, Nellore District. At the time when the matter is taken up for hearing, the learned Government Pleader for Assignment on instructions submits that in the year 1997 pattas in respect of the land in question were granted to some persons but no entries were made in the revenue records. Since the record is silent as to the assignment, again the said land was assigned to the petitioner under ExServiceman quota.

Though the petitioner claiming various reliefs but his main grievance is that the representation dated 04.09.2012 made to the second respondent is not considered till date and hence seeks a direction. Having regard to the circumstances stated above and taking into consideration the nature of averments made in the writ petition, the second respondent is directed to consider the representation dated 04.09.2012, if any made by the petitioner and pass orders in accordance with law as early as possible, preferably, within a period of twelve (12) weeks from the date of receipt a copy of this order.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall

stand closed.
