HON'BLE MRS JUSTICE SUREPALLI NANDA WRIT PETITION No.11916 OF 2013 ORDER:
The petitioner approached the Court seeking the relief is as follows:
"to issue a Writ or order or direction more particularly in the nature of Writ of Mandamus declaring the action of the respondents in not paying the due amount to the petitioner of Rs.3,50,000,00/- (Rupees Three Crores and Fifty lakhs only) for the works executed by the petitioner namely CPWS Scheme to Scarcity Habitations in Jagityal and other Habitations in Karimnagar District and CPSW Scheme to Raikal and 48 other habitations in Karimnagar District (herein after referred to as the said Project) is arbitrary, illegal, discriminatory and violation of Article 14 and 19 (1) (g) of the Constitution of India and consequently direct the respondents to release the due amount of Rs.3,50,000,00/- (Rupees three crores and fifty lakhs only) to the petitioner and pass such other order or orders may deem fit and proper in the interest of justice."

When the matter had been listed on 18.01.2023, there was no representation on behalf of learned counsel for the petitioner and hence, the matter had been directed to be listed on 23.01.2023 under the caption "for dismissal". When the matter was called on 23.01.2023, there was no representation on behalf of learned counsel for the petitioner as such the matter had been directed to be listed on 30.01.2023 under the caption "for dismissal".

Even today i.e., on 30.01.2023 there is no representation on behalf of learned counsel for the petitioner when the case is called. Learned counsel for the respondent No.7 is present.

Under these circumstances, the writ petition is dismissed for non-prosecution. However, there shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
