The vehicle was seized by order dated 04.11.2013 on the allegation of violation of the provisions of A.P. Excise Act, 1968. However, a direction was issued to the Station House Officer, Prohibition and Excise to release the vehicle subject to fulfilment of conditions mentioned therein. Learned counsel for the petitioner submits that the petitioner is a daily wage labour and he cannot fulfil the conditions, since one of the conditions for

release of the vehicle is to provide Fixed Deposit Receipt for the value of the vehicle.

Having regard to the facts of this case, the Writ Petition is disposed of directing the petitioner to furnish a third party security to the satisfaction of the Station House Officer, Prohibition and Excise. The petitioner shall fulfil all other conditions. On fulfilling such conditions, the vehicle in question shall be released in favour of the petitioner. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
