HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3959 of 2017 ORDER:

It is a renewed bail application filed under Section 438 of Cr.P.C. by the petitioner -accused No.1 against whom Crime No.15 of 2017 was registered by Narasaraopet I Town Police Station, Guntur District, for the offences punishable under Sections 323 and 506 read with 34 IPC and Section 3(1)(r)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 2015. His earlier bail application in Crl.P.No.3304 of 2017 was dismissed by this Court on 28.04.2017.

As can been, there are no perceivable changed circumstances to entertain the present petition.

Learned counsel for the petitioner sought to project the alleged changed circumstances to the effect that an eye witness, viz., Vattigunta Veeraiah Choudary, at whose shop the incident allegedly occurred, is ready to give a statement before this Court to the effect that the accused have not committed any offence, much less, abusing the de facto complainant in the name of his caste. 4.

A reading of his statement, which was already recorded by the Investigating Officer, prima facie, attracts the offences with which the accused charged. As such, there are no changed circumstances in the considered opinion of this Court. The question of inviting the witness here and make him to speak of certain facts is quite unknown

procedure sought to be introduced by the learned counsel. The same cannot be acceptable.

Accordingly, the criminal petition is dismissed. 6.
