THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.3725 of 2015 ORDER:

The petitioner/ Accused No.1 filed the present Criminal Petition under Section 438 Cr.P.C seeking release in the event of his arrest in connection with Crime No.42 of 2015 of Women P.S. Karimnagar, Karimnagar District, registered for the offences punishable under Section 498-A IPC, 323 r/w 34 IPC and Section 4 of Dowry Prohibition Act, 1961.

2. The case of the prosecution is that on 15.08.2014 the marriage of the informant was performed with A-1 as per Hindu rites and customs. At the time of marriage, the parents of the informant gave Rs.2 lakhs amount, 15 tulas of gold and Rs.3 lakhs worth of house hold articles as dowry. After the marriage, the informant and A1 lived happily. Thereafter, disputes were arose between the family members and as such accused No.1 along with informant shifted to IDPL Colony, where they lived happily for one month. On 13th December, 2014 the Accused No.1 is alleged to have beat and necked out the informant from the rented house. Basing on these allegations, the above report came to be registered.

3. Heard learned counsel for the petitioner and the learned Public Prosecutor for State.

4. A perusal of the averments in the report and the statement under Section 161 of Cr.P.C of the informant would disclose that the petitioner harassed the informant for additional dowry and ultimately necked her out of the house.

5. Having regard to the nature of allegations made, I am not inclined to grant anticipatory bail to petitioner. However, the petitioner

is directed to surrender before the concerned Court and make a suitable application, in which event the same shall be dealt with on merits in accordance with law either on the same day or atleast by next day.
