This writ petition is filed challenging the rejection order dated 17-02-2017 rejecting the application of the petitioner for mutation.
Learned counsel for the petitioner submits that without giving any reasons, without issuing any notice and without any speaking order, application of the petitioner was rejected. Learned Assistant Government Pleader for Revenue took time twice. No speaking order was produced. Hence, it is deemed that no speaking order was passed.
In view of the same, impugned rejection order is set aside on the ground of violation of principles of natural justice. The 4th respondent is directed to dispose of the application of the petitioner afresh after issuing notice to the petitioner and giving opportunity of hearing to him. Learned Assistant Government Pleader says that subject land is the forest land. But no reasoned order is passed and the said aspect has to be considered by the 4th respondent, while passing orders on the application of the petitioner. If the 4th respondent feels that interest of forest Department is likely to be affected, he is entitled to issue notice to the Forest department before passing orders on the application of the petitioner.
With the above direction, this writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 22-03-2017 Nvl
