THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37028 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents in opening the rowdy sheet against the petitioner in F.I.R.No.843 of 2011 in C.C.No.302 of 2012 on the file of the XIV Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, as illegal and arbitrary and consequently, to close the rowdy sheet opened against the petitioner. Heard and perused the material.

Learned counsel for the petitioner submits that petitioner has been falsely implicated by the third respondent in the said crime and that in the guise of the said offence, the third respondent herein opened a rowdy sheet against the petitioner in 2011. He further submits that the petitioner has not committed any crime and even subsequently also, the petitioner has not involved in any crime. Hence, he prays this Court to close the rowdy sheet against the petitioner. Considering the facts and circumstances of the case, the third respondent is directed to verify involvement of the petitioner in any other crime after 2011 and if it is found that the petitioner has not committed any offence after 2011, the third respondent is directed to close the rowdy sheet opened against the petitioner and pass appropriate orders to that effect.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 01.11.2016 pln
