HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.523 of 2016 ORDER:

This petition is filed to withdraw O.P.No.15 of 2016 from the file of Senior Civil Judge, Jagtial, Karimnagar District, and transfer the same to Family Court, Warangal.

Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 09.12.2014 at M.S.A. Emerald Function Hall, Warangal, as per Hindu rites and custom and that she joined respondent for marital life. She stated that respondent ill-treated her for additional dowry and finally she was necked out from the matrimonial home and the efforts for reconciliation made by her parents and elders are failed, therefore, she lodged a complaint with Women Police Station, Warangal, which is registered as Crime No.91 of 2016 and investigation is pending. She further stated that respondent filed O.P.No.15 of 2016 for dissolution of marriage and that it is difficult for her to go to Jagtial for the purpose of said case. She stated that there is threat to her life in the hands of respondent at Jagtial. She further stated that she is unable to travel for each and every adjournment to Jagtial, where divorce case is pending. For these reasons, she prayed for transfer of O.P.No.15 of 2016 from Senior Civil Judge, Jagtial, Karimnagar District, to Family Court, Warangal.

Respondent in spite of service neither appeared in person nor through any advocate.

Heard advocate for petitioner.

Considering the reasons stated in the affidavit filed in support of petition and considering convenience of wife, O.P.No.15 of 2016 is withdrawn from Senior Civil Judge, Jagtial, Karimnagar District, and transferred to Family Court, Warangal, for disposal in accordance with law.

Transfer C.M.P. is ordered accordingly.
