HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.34658 of 2016 Order:
This Writ Petition was filed challenging the action of the respondents in interfering with the construction activity of Sri Ganga Brahmaramba Sametha Malleswara Swamy Temple in Paritala village, Kanchikacherla Mandal, Krishna District.
This Court, by order dated 17.10.2016 while posting the matter to 24.10.2016, directed the second respondent not to interfere with the construction activity of the Temple being carried on by the petitioners. The said order was extended till another four weeks and it was observed that if the second respondent was harassing the unofficial respondents in view of the interim orders and hence the second respondent was directed not to harass the unofficial respondents. The interim order granted earlier on 17.10.2016 was further extended by order dated 26.12.2016. Today, when the matter is called, learned Government Pleader, on the basis of written instructions, submits that on the complaint made by the third respondent on 29.09.2016 before the second respondent against ten (10) persons including the petitioners herein a case in Crime No.
177 of 2016 was registered on 29.09.2016. After completion of investigation, charge sheet was filed on 06.10.2016 before the Additional Judicial Magistrate of First Class, Nandigama, which is numbered as C.C.No.521 of 2016. With regard to interference alleged by the petitioners, the second respondent denied the same.
In the circumstances, it is open to the parties to work out their civil remedies in accordance with law and so far as the trial of the case is concerned the Court before whom C.C.No.521 of 2016 is pending would
regulate the proceedings. In view of filing of charge sheet and registering C.C.No.521 of 2016, no further orders are required to be passed in the present Writ Petition.
The Writ Petition is, accordingly, closed. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
