HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.22077 of 2016 ORDER:

This writ petition is filed to declare the action of the 2nd respondent in not registering the sale transactions of the petitioner over his plots on the basis of a letter dated 12-042012 issued by the 3rd respondent, as illegal and arbitrary. Heard learned counsel for the petitioner.

It is stated by learned counsel for the petitioner that the present writ petition is covered by order dated 03-06-2016 in WP.No.17106 of 2016. The same is not disputed by Sri P.Jagadish Chandra Prasad, learned Standing Counsel for respondent No.3 and learned Assistant Government Pleader for Revenue.

For the reasons alike, this writ petition is allowed directing the Joint-Sub Registrar, Madhurawada to receive and process the documents presented by the petitioner in respect of Plot Nos.83, 84 and 85 in Sy.No.370 and 370/1 part of Madhurawada Village, Visakhapatnam Rural Mandal, Visakhapatnam District without reference to the letter dated 12-04-2012 issued by VUDA. In the event, the documents presented are found to fulfill the requirements of the Registration Act, 1908 and the Indian Stamp Act, 1899, the Joint Sub-Registrar, Madhurawada, shall complete the registration formalities and release the documents in accordance with the due procedure. It is made clear that mere registration of documents would not absolve the liability of the petitioner and his successors-in-interest of legal action

arising out of the enquiry that is stated to be pending with respondent No.3. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
