THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37029 of 2016 ORDER:
The writ petition is filed by the petitioners seeking a writ of certiorari to call for records pertaining to F.I.R.No.588 of 2016 for the offences under Sections 406, 420 and 506 IPC on the file of the fourth respondent at the instance of the fifth respondent and consequently to quash the same. Heard and perused the material.
Learned counsel for the petitioners submits that the fifth respondent has lodged the present complaint with all false allegations against the petitioners only to compel the petitioners to come to his terms as there is a civil suit, being O.S.No.2243 of 2016 pending between the petitioners and the fifth respondent, and as such, the petitioners have been falsely implicated in the present crime.
Considering the facts and circumstances of the case, and also as civil suit is pending adjudication between the petitioners and the fifth respondent, the fourth respondent is directed to complete the investigation without arresting the petitioners and file final report, if any, in accordance with law. The petitioners are directed to appear before the fourth respondent as and when required for the purpose of investigation. The writ petition is accordingly disposed of.
