THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3120 OF 2016 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, is filed by the petitioners - accused Nos.1 to 3 seeking to quash the proceeding against them in CC No.1481 of 2015 on the file of XXIV Metropolitan Magistrate, Kukatpally, Cyberabad, arising out of Crime No.32 of 2015 of Balanagr Police Station, Hyderabad, for the offences punishable under Sections 498-A IPC and 3 of Dowry Prohibition Act.

Heard and perused the material available on record. After arguing for some time, learned counsel for the petitioner submitted before this Court that NBW is pending against the 3rd petitioner - A3 and the same may be recalled and that the presence of the petitioners before the trial Court may be dispensed with.

Having heard the learned counsel for the petitioner and the learned Additional Public Prosecutor and having perused the material available on record, this Court is of the view that this criminal petition can be disposed of with the following directions: The 3rd petitioner - A3 is directed to approach the Court concerned and file a petition to recall the warrant issued against her and on such petition being filed, the Court concerned is directed to recall the warrant on the same day on her execution of a bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety for a like sum. The presence of the petitioners 2 and 3 i.e. A2 and A3 only is dispensed with before the trial Court and the 1st

petitioner - A1 is directed to appear before the trial Court on all hearing dates on his behalf and also on behalf of the other petitioners. However, the petitioners shall be properly represented through their counsel on all hearing dates.

With the above directions, the Criminal Petition is disposed of. Consequently, the Miscellaneous Petitions pending, if any, shall stand closed.
