HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.42690 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioners seeking to declare the inaction of the 2nd respondent in following the principles laid down by a Full Bench of this Court in W.A.No.343 of 2015 & batch and to give direction to the 4th respondent to entertain the deeds for registration of lands in survey No.115 of Narsannapally Village, Kamareddy Mandal and District, as illegal and arbitrary. Heard the learned counsel for the petitioners as well as the learned Government Pleader for Registration and Stamps for respondents. With their consent, the writ petition is disposed of at the stage of admission itself.

Though various grounds are raised in the writ petition, the learned counsel for the petitioners restricts his prayer seeking a direction to the respondents to deal with the representation made by the petitioners for deletion of the properties, which are the subject matter of the dispute in the present writ petition, from the 'Prohibitory list' under Section 22-A of the Registration Act. Learned Government Pleader would submit that a suitable direction may be given to the 2nd respondent to pass orders on the representation made by the petitioners, if the same is still pending consideration, in accordance with law.

Having regard to the rival submissions made, the Writ Petition is disposed of directing the 2nd respondent-The Collector,

Nizamabad, to deal with the representation dated 27.04.2016 made by the petitioners for deletion of properties belonging to them covered by survey No.115 situated at Narsannapally Village of Kamareddy Mandal, from the Prohibitory List, in accordance with law and pass necessary orders thereon as early as possible preferably within a period of six weeks from the date of receipt of a copy of this order.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
