THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 22955 of 2019 ORDER:

In this Writ Petition, petitioners claim proprietary rights in the property, over which, the third respondent was granted approved layout. Their grievance is that they had filed objections before the second respondent - Commissioner, Hyderabad Metropolitan Development Authority (HMDA), Hyderabad, on 24.03.2019 and 05.09.2019 informing about the pendency of the civil suits with respect to the subject property, but, the second respondent is not considering the same as yet. Learned Standing Counsel for HMDA appearing for the second respondent submits that as there is no system of maintaining caveat in anticipation of someone applying for the layout permission, even assuming that the petitioners had submitted objections with respect to the subject property, non-consideration of the same cannot be found fault with. He also submits that the objections of the petitioners will be considered and appropriate decision would be communicated to them within a period of six (6) weeks.

Recording the aforesaid submission, this Writ Petition is disposed of with the direction to the second respondent to

CKR, J W.P.No.22955 of 2019 consider the objections stated to have been filed by the petitioners on 24.03.2019 and 05.09.2019 and take a decision thereon in accordance with law and communicate the same to the petitioners. This exercise shall be completed within a period of six (6) weeks from the date of receipt of a copy of this order. It is needless to mention that the petitioners as well as the third and fourth respondents are issued notice and enquiry be conducted in accordance with law.

Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
