Learned counsel for the petitioner submitted that the petitioner may be permitted to withdraw the criminal petition with a liberty to file an application for discharge of the petitioner before the Magistrate. Recording the above submission, the criminal petition is dismissed as withdrawn with a liberty as prayed for.
