This writ petition is filed challenging the order dated 7.2.2017 passed by the 2nd respondent rejecting the request of the petitioner for release of the stock seized in Crime No.681/2016-17. 2.

Heard and perused the material available on record. 3.

It is the case of the respondents that the petitioner was found in illegal possession of 6,795 kgs of white jaggery and therefore, the stock was seized and a case in Crime No.681/2016-2017 was registered. On that, the petitioner made a representation before the 2nd respondent to release the stock and the said representation was rejected. Hence, the petitioner filed this writ petition.

The learned Counsel for the petitioner submitted that the jaggery is not a prohibited item and that the petitioner is ready to furnish surety. 5.

Considering the facts and circumstances of the case, the respondentsauthorities concerned are directed to release white jaggery i.e., 6,795 kgs seized in the above crime to the petitioner on condition of his executing a personal bond for a sum of Rs.67,950/- (Rupees Sixty Seven Thousand Nine Hundred and Fifty only) to the satisfaction of the 2nd respondent. However, this order does not preclude the authorities concerned from proceeding with the confiscation proceedings, if any. 6.

Accordingly, the Writ Petition is disposed of. Consequently, the miscellaneous petitions pending in this petition, if any, shall stand closed. _________________ Justice Raja Elango Dated: 1.6.2017.
