HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.1997 OF 2017 ORDER:

The case of the petitioner is that the 3rd respondent suo moto entertained the appeal, after lapse of 12 years without there being any delay condonation petition and cancelled the pattadar pass books and title deeds issued in favour of the petitioner vide proceedings No.D.Dis.D2/497/ 2016, dated 03.09.2016 and directed the 4th respondent to delete the entries made in ROR records in favour of the petitioner. Against the same, the petitioner filed Revision under Section 9 of the Andhra Pradesh Rights in Land and Pattadar Pass Book Act, 1971, before the 2nd respondent on 27.10.2016. Pending the same, the 4th respondent vide order dated 23.12.2016 in Rc.No.131/2016 ordered for mutation of the name of the 5th respondent in the revenue records. Aggrieved by the same, the present writ petition is filed.

Learned counsel for the petitioner submits that the 3rd respondent entertained the appeal after a lapse of 12 years without any delay condonation and cancelled the pattadar pass books and title deeds granted in favour of the petitioner vide order dated 03.09.2016. In pursuant to the orders of the 3rd respondent, the 4th respondent issued proceedings dated 23.12.2016.

Heard the learned Assistant Government Pleader for Revenue.

In view of the above facts and circumstances, the 2nd respondent is directed to dispose of the Revision filed by the petitioner against the order dated 03.09.2016. Pending disposal of the Revision, there shall be stay of proceedings dated 03.09.2016 issued by the 3rd respondent as well as proceedings dated 23.12.2016 issued by the 4th respondent. With the above direction, the writ petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed.
