Petitioner filed this Writ Petition praying to grant the following relief:
" To issue a writ or order or direction more particularly one in the nature of Writ of Mandamus declaring that the action of the respondent No.1 in not ordering re-engagement with continuity of service of the petitioner as contract Driver is bad, arbitrary, illegal, unjust, unreasonable as the termination of the petitioner is against to the principles of natural justice and against to the Corporation circulars and consequently direct the respondents to treat 1st respondent proceedings, dated 21.11.2008 as reinstatement of the petitioner as Driver with continuity of service, attendant benefits and with all consequential service benefits ....."

Petitioner was working as Contract Conductor from May, 2006. On the allegation of unauthorized absence from duties, petitioner was terminated from service by order dated 26.05.2008. On appeal, the appellate authority vide his order dated 21.11.2008 set aside the termination order and directed to reengage as afresh contract Driver.

When the matter is taken up for hearing, learned standing counsel informed the Court that service of petitioner was regularized w.e.f.01.09.2013 and he died on 28.10.2015. 4.
No steps are taken to bring LRs of petitioner on record. Cause in the Writ Petition abates. Writ Petition is accordingly dismissed. Pending miscellaneous petitions shall stand closed. __________________________ JUSTICE P.NAVEEN RAO Date: 20.02.2020 kkm
