Petitioner is the South Central Railway Employees Mutually Aided Co-operative Housing Society and it is represented by its President. The grievance of the petitioner - Society is that the respondents 2 and 3 - authorities of Transco, have changed the alignment and issued notice, which was received by the petitioner on 02.10.2019, proposing to lay power transmission lines/towers through its land, and though a representation dated 03.10.2019 was made to said authorities raising the objections, the same have not been considered. Hence, aggrieved by the action of the respondents 2 and 3 in proposing to law transmission lines/tower through the land of the petitioner - society, the present writ petition is filed.
Heard the learned counsel for the petitioner, who submits that the respondents may be directed to consider the representation of the petitioner dated 03.10.2019, and to take appropriate in accordance with law. Sri R.Vinod Reddy, learned Standing Counsel for respondents 2 and 3 submits that change in alignment was necessitated because of the technical reason, as a canal intervened between the towers originally proposed to be laid, and hence the request of petitioner - society not to lay towers in the subject land, cannot be acceded to.
Since the objections raised by the petitioner - Society by way of representation dated 03.10.2019 is stated to be pending with respondents 2 and 3, without expressing any opinion on merits, writ petition is disposed of
directing the competent authority among respondents 2 and 3, to consider the said representation dated 03.10.2019, and after giving notice and opportunity of hearing to the petitioner, shall pass appropriate orders in accordance with law, within a period of two weeks from the date of receipt of a copy of this order, and communicate the same to the petitioner. Interlocutory applications pending, if any, shall stand closed. No order as to costs.
