THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.42300 OF 2015 O R D E R :

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The grievance of the petitioner is with regard to the inaction on the part of the 5th respondent in not taking proper action and not conducting enquiry on his application dated 17.03.2015 in spite of the fact that there is an earlier direction issued by this Court in W.P.No.10439 of 2007, dated 04.06.2014 to the 3rd respondent to decide the issue and pass appropriate orders. Though there is already direction issued by this Court, the petitioner's application is pending since 17.03.2015. In view of the facts and circumstances of the case, it is appropriate to direct the 5th respondent to examine the petitioner's application in the light of the directions of this Court referred above and take appropriate decision in the matter after conducting necessary enquiry after issuing notice to the effected parties, if any, and communicate the said decision to the petitioner preferably within a period of two months from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in the writ petition shall stand closed.
