THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37236 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to declare the action of the respondents in opening and continuing the rowdy sheet against the petitioner as illegal and arbitrary and consequently, to direct the respondents to close the rowdy sheet against the petitioner with immediate effect.

Case of the petitioner is that respondent No.5 opened a rowdy sheet against him in the year 2013 and is continuing the same without closing it. Crime No.87 of 2012 on the file of Amalapuram Town Police Station was registered against him and another for the offences under Sections 364-A and 302 I.P.C. and later, the same was numbered as PRC No.15 of 2013 on the file of the Additional Judicial First Class Magistrate, Amalapuram and later, the same was made over to the Sessions Court and numbered as Sessions Case No.276 of 2013 on the file of the VI Additional Sessions Judge (FAC II Additional Sessions Judge), Amalapuram and the said case ended in acquittal on 8.1.2016. Thereafter, the petitioner has not committed any crime and hence, he prays to give a direction to the respondents to remove his name from the rowdy sheet.

Heard and perused the material available on record. 4.

Considering the facts and circumstances of the case and the grievance of the petitioner, the petitioner is directed to make an application to respondent No.4 herein - The Sub-Divisional Police

Officer, Amalapuram, East Godavari District for removal of his name from the rowdy sheet by placing all the material and the relevant documents and on such application, the Sub-Divisional Police Officer, Amalapuram shall dispose of the same in accordance with law on or before 10.12.2016.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
