HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.10514 of 2009 ORDER:

This writ petition was filed challenging the action of the respondent in not conducting public auction to lease out the maintenance rights of Damaraju Venkat Rao Park situated within the limits of Eluru Municipal Corporation, West Godavari District. 2.

A counter-affidavit was filed by the respondent stating that the lease for the period 2008-2009 expired by the end of March, 2009 and the lessee was asked to vacate the same. After vacation of the lease holder, a fresh lease was notified and the petitioner emerged as the highest bidder for the year 2009-2010.

In view of the same, nothing survives for consideration in the present writ petition. The Writ Petition is accordingly dismissed as infructuous. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
