Suffice to note that on 28.06.2017 notice under Section 7 of the Andhra Pradesh Land Encroachments Act, 1905 (for short 'the Act'), was issued calling upon the petitioner to show cause as to why petitioner should not be evicted from the Government land to an extent of Ac.2-00 in Sy.No.210/A2 of Chinnadudyala Village in her occupation. On 07.08.2017 petitioner filed written explanation stating that she was not aware that the land belongs to Government and due to mistake, she has cultivated the Government land. She gave an undertaking that she would vacate the Government land, as soon as the Tomato crop is taken. Alleging forcible eviction, even before the crop already laid is removed, this writ petition is filed.

Having regard to the submissions, made the Court is not recording detailed reasons in support of the decision. Since petitioner has already gave an undertaking to vacate the subject land after the Tomato crop is raised, the Writ Petition is disposed of, directing the respondents not to disturb the petitioner's possession till the present Tomato crop is taken. Petitioner shall hand over possession of the subject land within two (2) weeks of taking away of the Tomato crop. For any reason, if petitioner does not cooperate, it is open to the respondents to take possession of the subject land forcibly, and the petitioner is not entitled to any relief thereon. There shall be no order as to costs.

- 3 - Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
