Heard learned counsel for the petitioner and learned Standing counsel for the Telangana State Road Transport Corporation.

Petitioner challenges the order of Depot Manager, Warangal, dated 21.05.2018 directing recovery of an amount of Rs.4,26,929/-. This order is primarily challenged on the ground that the same is made without putting the petitioner on notice and without giving opportunity to him.

Having regard to this contention, learned Standing counsel also fairly submits that the impugned order can be set aside on the said ground and to grant them liberty to follow due process. 4.

Having regard to the said submissions, the order impugned is set aside and the Writ Petition is allowed. However, it is open to the respondents to take action against the petitioner in accordance with law. No adverse decision can be made without putting the petitioner on notice by giving details of amount alleged to have been paid in excess and after affording due opportunity, pass appropriate orders as warranted by law, by assigning reasons in support of the decision. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
