HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 3730 of 2017 ORDER:

The Writ Petition is filed questioning seizure of vehicle on the allegation that the petitioner was transporting black jaggery.

Under Section 46 of the A.P.Excise Act, the Deputy Commissioner of Excise is the competent authority. In as much as the petitioner has not approached the competent authority, the Writ Petition is disposed of giving liberty to the petitioner to approach the second respondent - Deputy Commissioner of Prohibition and Excise, Adilabad under Section 46 of the Act and file application. The second respondent shall consider and dispose of the application within a period of ten days thereafter.

Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
