THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.32604 OF 2015 ORDER:

The petitioner is a license holder of kerosene of Circle No.25 of Nindujerla Village, Atchempeta Mandal, Guntur District and his authorization is valid up to 31.12.2016. While so, a show cause notice was issued to him on 13.12.2014 directing him to submit explanation within five days. It appears that the said show cause notice was issued on the basis of a report issued by the CSDT, Pedakurapadu on 10.12.2014. Proceedings under Section 6-A of the Essential Commodities Act have been pending before the Joint Collector. Challenging the suspension order passed by the third respondent on 18.12.2014, the present Writ Petition is filed.

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies for the respondents. It is submitted by the learned counsel for the petitioner that no final order was passed by the third respondent so far.

In the circumstances, the Writ Petition is disposed of directing the third respondent to conduct an enquiry and pass final orders pursuant to the show cause notice dated 13.12.2014 within a period of sixty (60) days from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
