HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 14175 OF 2009 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.

In this writ petition, in the nature of public interest filed in 2009, the petitioner seeks the following relief:

"For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a WRIT more in the nature of MANDAMUS, declaring the action of the Respondents to assign or endow forest land in the Markapur Forest Division to others as arbitrary, ultravires, unjust and unconstitutional and it is also prayed for the grant of such other and further reliefs as may be deemed fit and proper in the circumstances of the case." The respondents have filed counter affidavit and stated that out of 1,454 claims made by tribals, they have allowed only 106 claims and allotted those claimants Ac.1.00 of land each under the provisions of the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006.

In view thereof, learned counsel for the petitioner does not press this writ petition and seeks liberty to the petitioner to approach the concerned authority, if he finds that allotment of land is made to undeserving persons, and contrary to the provisions of the said Act. He seeks direction to consider the representation of the petitioner, if any, expeditiously.

Writ petition is disposed of as not pressed with liberty as

prayed. It is made clear that if the petitioner makes such representation, the concerned authority may consider his representation in accordance with law, expeditiously. All contentions in respect thereof are kept open.
