2015-12-04Vilas V.Afzulpurkar3 pages

HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.39436 of 2015 ORDER:

Heard.

The grievance of the petitioner is that his patta land is included in the prohibitory list and thereby, he is disabled from alienating his land. He has already made a representation before the 4th respondent requesting to delete the entry of his land from the prohibitory list and show it as his patta land. However, under Section 22-A (4) of the Registration Act, 1908, the petitioner needs to make such a request before the 2nd respondent, who has power to modify the list notified under Section 22-A of the Act, if satisfied by deleting the petitioner's land. Hence, liberty is given liberty to make appropriate application before the 2nd respondent. If any such application is made by the petitioner, the 2nd respondent shall examine the same and pass appropriate orders, expeditiously, in accordance with law.

Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. _______________________ VILAS V.AFZULPURKAR, J Date: 04-12-2015 Prv
