THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.6407 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A4 in Crime No.46 of 2022 on the file of Marriguda Police Station, Nalgonda, registered for the offences punishable under Sections 417, 420, 312, 342, 376(2)(n) of Indian Penal Code and under Section 5(1) read with 6 of POCSO Act, 2012.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that Accused No.1 and the victim girl were in love with each other and participated in sexual intercourse several times resulting in pregnancy of the victim. Thereafter, she was taken to the doctor and injected with some medicine which resulted in abortion.

The allegation against this petitioner/A4 is that he had taken the victim girl to the Gynaecologist in the hospital where she was aborted.

Except the said allegation of assisting the victim girl to the hospital where A6-Gynaecologist aborted the victim girl, no other allegations are leveled against this petitioner. The petitioner is in jail since 10.05.2022.

In the said circumstances, the petitioner/A4 can be granted bail.

Accordingly, the Criminal is allowed and the petitioner/A4 is granted bail subject to the following conditions:

i) The petitioner/A4 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of I Additional District & Sessions Judge at Nalgonda.

ii) The petitioner/A4 shall appear before the concerned Station House Officer on every Monday

between 10.30 AM and 01.00 PM for a period of six weeks, for the purpose of investigation.

iii) The petitioner/A4 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed.
