HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.36104 of 2016 ORDER:

1) Heard learned counsel for the petitioners and Government Pleader for revenue. With the consent of both the parties, the writ petition is being heard at the admission stage itself. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent Nos.2 and 4 proposing to dispossess the petitioners by demolishing their houses situated in CAS No.378 of Mansoor Nagar and CAS No.1423 of Pamula Manyam of Nellore Town, SPSR Nellore District, without following due procedure contemplated under law, as illegal, arbitrary and violative of principles of natural justice; and consequently to direct the respondents not to dispossess the petitioners from the said property.

3) Though various grounds are raised learned counsel for the petitioners restricts his prayer seeking a direction to the respondents to follow due process of law.

4) Having regard to the facts and circumstances of the case and without going into the merits of the case, the present writ petition is disposed of, directing the respondents not to interfere with the subject properties except in accordance with the due procedure laid down by law. No order as to costs.

5) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
