THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.22050 OF 2015 ORDER:
The petitioner was appointed as fair price shop dealer of shop No.16, TDR Rajupeta village, Bujra Mandal of Srikakulam District. While so, a complaint was made against the petitioner on 24-11-2014 to the District Collector and also to the Tahsildar. Basing on the said complaint, the Tahsildar enquired into the matter and submitted a report, dated 20-04-2015. Thereafter, a show cause notice was issued to the petitioner by the 2nd respondent and the petitioner submitted his explanation on 20-05-2015. After considering the explanation of the petitioner, the authorization of the petitioner was cancelled by order, dated 03-06-2015. Challenging the same, the present writ petition is filed.
2. This Court carefully perused the allegations levelled against the petitioner and those allegations relate to supply of stock to the noneligible persons, dead persons and migrated persons. The allegations can be enquired into only by the appellate authority. 3.
In the circumstances, the writ petition is dismissed. However, liberty is given to the petitioner to avail remedy of filing appeal before the appellate authority within 15 days from the date of receipt of a copy of this order. No order as to costs.
