HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.4055 of 2013 ORDER :

This Court passed an order dated 02.12.2015 with the following directions:

"Having regard to the above and from the fact that the calendar case not ripen for trial under Section 145 of the Negotiable Instruments Act by commencement and not a case in revision or appeal to apply the rider of 15% even from what is laid down in Damodar S. Prabhu, this Court feels to subserve the ends of justice to impose Rs.1,00,000/- towards costs in directing to deposit to the Chief Justice Relief Fund on or before 09.12.2015.

Having regard to the above, the petitioners are directed to deposit an amount of Rs.1,00,000/- to the Chief Justice Relief Fund on or before 09.12.2015, failing which this petition will be dismissed automatically and without prejudice to the contest but for to plead what is paid to the complainant, before the trial Court. For compliance and further orders, post the matter on 10.12.2015".

2) The petitioners complied the orders dated 02.12.2015 and filed receipt No.25, dated 09.12.2015.

Accordingly, compromise recorded and all proceedings in C.C. No.84 of 2013 on the file of XXII Special Magistrate, Erramanzil are hereby quashed. The bail bonds of the accused, if any, shall stand cancelled. Consequently, miscellaneous petitions, if any, shall stand closed.
