ORDER
This writ petition is filed seeking the following relief: "....to issue a writ, order or directions more in the nature of Writ of Mandamus declaring the action of the respondents herein in not restoring the deferred increments after completion of punishment period (which were deferred as without effect on future increments as a measure of minor punishments) as illegal, arbitrary and contrary to law and violation of principles of natural justice and set aside the same and further direct the respondents herein to restore the deferred increments after completion of punishment period and re-fix the pay of petitioner and pay arrears and pass such other order or orders in the interest of justice as otherwise the petitioner may suffer irreparable loss and hardship."
Heard Sri P.Govindarajulu, learned counsel appearing for the petitioner and Sri A.Ravi Bau, learned Standing Counsel appearing for the respondent-Corporation. Learned counsel appearing for the petitioner submits that though the petitioner has submitted a representation dated 5.1.2012 to the respondent-Corporation for release of deferred increments after expiry of punishment period, no orders have been passed so far.
Learned Standing Counsel appearing for the respondent-Corporation submits that the respondent-
Corporation has released the deferred increments to the petitioner during October, 2012. However, if the petitioner submits a representation afresh, his case would be considered and appropriate orders would be passed thereon, if not already released.
Having considered the rival submissions made by the learned counsel on either side, this Writ Petition can be disposed of directing the petitioner to submit a representation afresh to the respondent-Corporation within a period of two weeks from the date of receipt of a copy of this order staking his claim for release of deferred increments. On receipt of such representation, the respondent-Corporation shall consider and pass appropriate orders thereon, within a period of six weeks thereafter, if not already released. Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed.
