HYDERABAD MAIN CASE NO: Crl.P.No.8245 of 2023 PROCEEDING SHEET 04.01.2024 KS,J I.A.No.1 OF 2023 This application is filed seeking to relax the following condition imposed by this Court vide order dated 11.09.2023 in Crl.P.No.8245 of 2023.
"The petitioners/A-3 and A-5 after release shall appear before the concerned Investigating Officer of GST at 10:00 a.m. on every Monday and also on other days as and when required by the Investigating Officer for the purpose of investigation".
Learned counsel for the petitioners/A-3 & A-5 submits that petitioners are appearing before the Investigating Officer of GST as ordered by this Court and they are cooperating with the Investigating Agencies. He further submits that except filing of charge sheet, entire investigation in the above crime has been completed. But it has been more than 3 1⁄2 years since the respondent authorities have taken up investigation, the charge sheet has not been filed. The petitioners firmly believe that the charge sheet is deliberately not filed to subject the petitioners to harassment. Hence, he seeks relaxation of above said condition.
Since the petitioners are appearing in
accordance with the orders of this Court regularly, this Court deems it appropriate to relax the above said condition imposed by this Court.
Accordingly, the petitioners are directed to appear before the Investigating Authorities as and when required by the Agency.
