HON'BLE MRS JUSTICE SUREPALLI NANDA WRIT PETITION No.26899 OF 2021 ORDER:

The petitioner filed the present writ petition seeking the prayer as follows:

"To issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent in not passing any order basing in Case No.8/2021 filed by the petitioner on 04.02.2021 against the 3rd respondent who is ill treated the petitioner's father causing death of the petitioner's father namely Dr.K.Indra Sena Reddy died on 07.01.2020 in the 3rd respondent hospital by receiving the huge amounts on the medical treatment is highly illegal, arbitrary and against the principles of natural justice and also violative of Articles 14, 19 and of the Constitution of India and consequently direct the 3rd respondent to pay the compensation amount of Rs.25,00,000/- due to negligence treatment and caused the death of the petitioner's father in the interest of justice and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the interest of justice."

Learned counsel appearing on behalf of respondent Nos.2 and 3 submitted that the writ petition could be disposed of directing the 2nd respondent to consider the case No.8/2021 filed by the petitioner on 04.02.2021 against the 3rd respondent.

The specific case of the petitioner in the said appeal is that the 3rd respondent ill treated the petitioner's father causing the death of the petitioner's father namely Dr.K.Indra Sena Reddy, who died on 07.01.2020 in the 3rd respondent hospital by receiving huge amounts on the medical treatment.

Taking into consideration the above referred facts and circumstances, the writ petition is disposed of directing the 2nd respondent to consider the case No.8/2021 filed by the petitioner on 04.02.2021 against the 3rd respondent on merits, by giving due notice and opportunity to the petitioner as well as 3rd respondent in accordance to law, within a period of six

(06) months from the date of receipt of copy of this order, duly communicating the said decision to the

petitioner as well as 3rd respondent. However, there shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
