THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.3985 of 2015 ORDER:
Petitioner herein was working as driver in the respondent Corporation. By order, dated 05.06.2012, the Depot Manager, Kanigiri, has terminated his services on the ground of unexplained unauthorized absence. The petitioner states that against the said order, he has preferred an appeal before the second respondent on 06.06.2013. He also states that the said appeal, though pending for a long time, is not being disposed of, while the present Writ Petition is directed against the order of termination dated 05.06.2012. In view of pendency of the appeal against the said order, I am not inclined to go into the merits of the contentions raised by the learned counsel for the petitioner.
Learned Standing Counsel for APSRTC appearing for the respondents also states that the petitioner's appeal is still pending and that it would be disposed of expeditiously.
In view of that, the Writ Petition is disposed of directing the second respondent to consider the petitioner's appeal as early as possible and pass appropriate orders preferably within two months from the date of receipt of a copy of this order. No order as to costs. Miscellaneous Petitions, if any pending in this Writ Petition shall stand closed.
