OFFICE NOTE 19.12.2023 KS, J I.A.NO.1 OF 2023 This application is filed seeking to relax the condition No.iii imposed against the petitioners/A4 & A6 in Crl.P.8246 of 2023 dt.11.09.2023 in connection with File No.GEXCOM/AE/INV/GST/1473/2023AE-RR that petitioners/A4 & A6 shall appear before the concerned Investigating Officer of GST at 10.00 a.m. on every Monday and also on other days as and when required by the Investigating Officer for the purpose of investigation.
Learned Counsel for the petitioners/A4 & A6 submits that the petitioners are appearing before the Investigating Officer of GST as ordered by this Court and they are co-operating with the investigating agencies.
Learned counsel further submits that the entire investigation in the above crime has been completed except for filing of charge sheet.
But, it has been more than three and half months, since the respondent/GST authorities have taken up investigation but
however, the charge sheet has not being filed and the petitioners firmly believes that the charge sheet in above crime is not being deliberately filed to subject the petitioners to harassment. Hence, he seeks relaxation of the said condition.
Since, the petitioners/A4 & A6 are appearing in accordance with the orders of this Court, this Court deems it appropriate to relax the condition imposed against the petitioners/A4 & A6 in Crl.P.8246 of dt.11.09.2023, is relaxed and the petitioners are directed to appear before the investigating authorities, as and when required by the agency.
