THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY W.P.NO.19880 OF 2018

O R D E R

Alleging that though no crime is registered against the petitioner and his parents, the 2nd respondent - Station House Officer, Women Police Station, Central Crime Station, Basheerbagh, Hyderabad, is calling them to the police station and making them to sit for hours together at the behest of 3rd respondent, the present writ petition is filed for a direction to the 2nd respondent not to call them to police station. Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Home, produced written instructions of the 2nd respondent, wherein he stated that a complaint was received from the 3rd respondent, who is the wife of the petitioner alleging harassment at the hands of the petitioner and his parents and that after receipt of complaint, he referred them for counseling and both the parties compromised.

In the written instructions, the allegations of the petitioners were not denied. There cannot be any dispute that in matrimonial disputes, parties have to be initially referred to mediation, but under the guise of counseling, parties cannot be made to sit in the police station for hours together.

In view of the same, 2nd respondent is directed not to call the petitioner or his parents to the police station, except in accordance with law.

With the above direction, writ petition is disposed of. Miscellaneous petitions pending, if any, shall stand closed. No costs. ------------------------------------------ A.RAJASHEKER REDDY,J DATE:22-06-2018 AVS
