HONOURABLE SRI JUSTICE T.AMARNATH GOUD CRIMINAL PETITION No.6639 of 2019 ORDER:

This Criminal Petition is filed under Section 482 of the Code of the Criminal Procedure, 1973, seeking to quash the order dated 01.10.2019 passed by the learned I Additional Metropolitan Sessions Judge, Hyderabad in Crl.M.P.No.829 of 2019 in S.C.No.14 of 2019.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondents. Since the Constitution has protected the citizens right towards education and as per the grounds stated in the pleadings that the right of the citizen, who is arrayed as accused is at stake, but for the pendency of the criminal proceedings, this Court feels that if the accused is not found guilty his career and the image of the family would be tarnished during the pendency. Hence to give an opportunity to the accused person to pursue his education, this Court feel that this petition to be disposed of directing the Court below to complete the legal formalities required under law regarding framing of charges and proceed with the trial and decide the matter as expeditiously as possible, preferably, within a period of six months from the date of receipt of a copy of this order. With the above direction, the Criminal Petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
