THE HON'BLE SRI JUSTICE C.V.BHASKAR REDDY Contempt Case No.1567 of 2013 ORDER:

This Contempt Case is filed alleging violation of orders dated 22.06.2012 passed by this Court in W.P.No.18636of 2012. By the above said order this Court has directed respondent Nos.1 to 4 therein to stop the construction activity carried out by respondent No.5(respondent No.3 herein) in premises bearing Municipal No.3-4-101/D, in the land admeasuring 279 Sq.Yards, situated at Lakshmi Nagar, Ramanthapur, Uppal Mandal, Ranga Reddy District.

Respondent No.3 has filed counter affidavit stating that the respondent No.3 has entered into a development agreement with M/s.Niveditha Constructions on 26.04.2010 and consequently also entered registered Development Cum-Power of Attorney, bearing document No.9948 of 2010 dated 22.12.2012 in respect of the subject property. Further, the construction has been completed by the end of December 2011 and sales were also effected in favour of third parties. As such there is no violation of the interim orders granted by this Court intentionally or willfully and prayed for disposal of the contempt case.

Recording the above submission, this Contempt Case is closed. However, liberty is granted to the petitioner, if any cause survives, to

file fresh application seeking revival of the contempt case in accordance with law.

Miscellaneous petitions, if any pending in this contempt case shall stand closed.
