HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.4263 OF 2009 O R D E R :
This writ petition is filed declaring the proceedings No.D.Dis.No.4636/2008/JA (Inams) dated 09.02.2000 passed by the 1st respondent, as illegal and arbitrary. Learned counsel for the petitioner, learned Assistant Government Pleader for Revenue and the learned counsel appearing for respondents 3 to 5 submit that the 1st respondent has not considered the claims made by the petitioner as well as the claims of unofficial respondents in proper perspective. Therefore, the impugned order is liable to be set aside and the matter has to be remanded to the 1st respondent. Recording the said submission, the impugned order is set aside and the matter is remanded back to the 1st respondent. The 1st respondent is directed to consider the matter afresh after issuing notice to the petitioner as well as the unofficial respondents.
Accordingly the writ petition is allowed. However, the interim order granted by this Court on 03.03.2009 shall continue till the orders are passed by the 1st respondent after considering the matter afresh. No costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
