THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 45371 of 2016 ORDER:

This writ petition was filed challenging the action of respondent Nos.2 to 4 in not filing charge-sheet in spite of registration of F.I.R.No.160 of 2015, dated 07.11.2015, on the file of Sabbavaram Police Station, Visakhapatnam.

Now, a counter-affidavit is filed by respondent No.4 stating that during the course of investigation, the Investigating Officer examined 11 witnesses and recorded their statements. After completion of investigation, the case was closed as false, as per the orders of the Deputy Inspector General of Police, Visakhapatnam Range, Visakhapatnam, dated 01.10.2016. A final report was also filed before the II Additional Metropolitan Magistrate, Anakapalli, vide Rc.No.08 of 2016, dated 07.11.2016.

In view of the same, no further orders are necessary in the present writ petition. However, it is open to the petitioner to take appropriate legal proceedings in accordance with law. The writ petition is accordingly closed.
