THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CIVIL REVISION PETITION No.3296 OF 2018 ORDER:

This civil revision petition is filed under Article 227 of the Constitution of India, challenging the order dated 12.6.2018 in I.A. No.725 of 2018 in O.P.No.1107 of 2013 on the file of the Additional Family Court, City Civil Court, Hyderabad.

Sri V.V.Narayana Rao, learned counsel takes notice on behalf of the respondent.

The petitioner filed I.A.No.725 of 2018 under Order XVII Rule 1 of CPC seeking adjournment of the O.P. to 27.6.2018, as the petitioner will come to India on 25.6.2018.

At the time of hearing, learned counsel for both the parties submitted that the petitioner may be directed to appear before the trial Court on 27.6.2018 for the purpose of cross-examination. In view of the submission made by both counsel, this Court is not inclined to go into merits of the main case.

Accordingly, the civil revision petition is allowed setting aside the order dated 12.6.2018 in I.A. No.725 of 2018 in O.P.No.1107 of 2013 on the file of the Additional Family Court, City Civil Court, Hyderabad. Consequently, I.A.No.725 of 2018 stands allowed. The petitioner is hereby directed to appear before the Additional Family Court, City Civil Court, Hyderabad on 27.6.2018 for the purpose of cross-examination in O.P. No.1107 of 2013, failing which the trial Court can proceed with the O.P., in accordance

with law. Miscellaneous petitions if any pending in this petition shall stand closed.
