HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Transfer Criminal Petition No.192 of 2014 ORDER:

The mother and natural guardian of minor petitioner-Syed Asad Ahmed filed the present petition seeking transfer of Crl.M.P.No.16 of 2014 in FCMC No.12 of 2010 from the Family Judge-cum-Additional District and Sessions Judge, Karimnagar to the Family Court, Medak at Sangareddy on the submission that MC No.12 of 2010 was decreed ordering payment of monthly maintenance of Rs.3,500/- and later Crl.R.C.No.1700 of 2011 filed by the respondent who is her husband, monthly maintenance amount was reduced to Rs.3,000/- and respondent is not properly depositing the amount in spite of filing execution petition and the petitioner is not able to go all the way from Sangareddy to Karimnagar to get the meager amount and further her health condition is not good and hence the petition may be transferred to Family Court, Sangareddy.

Notice was ordered to second respondent but there is no representation on his behalf.

As can be seen, the main maintenance case was already disposed of and execution petition only seems to be pending in the Family Court at Karimnagar. Having regard to the stage of the matter, the petitioner unlike in the stage of trial need not attend the said Court regularly. So, at this stage of the matter, it is not apposite to transfer Crl.M.P.No.16 of 2014. Hence, I find no merits in the petition.

Accordingly, this Transfer Criminal Petition is dismissed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
