THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9481 OF 2015 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/A.1 seeking grant of anticipatory bail in crime No.378 of 2015 on the file of the Penamaluru Police Station, Vijayawada, Krishna District, registered for the offences under Sections 376(2)(n), 376(D), 366A, 343 IPC and Section 6 of POCSO Act and Sections 3, 4, 5 and 6 of the Immoral Traffic Prevention Act. Heard and perused the material available on record. The case of the prosecution is that the petitioner/A.1 along with the others kept the de facto complainant in a room for three days and they forced her to have sex with number of persons to gain money.

Taking into consideration the allegations and on perusing the petition filed by the Investigating Officer seeking remand of the accused, this Court is of the view that the petitioner herein is the brain behind the entire episode of procuring girls and forced them to become the brothels, and as such, this Court is not inclined to grant anticipatory bail to the petitioner/A.1. The criminal petition is accordingly dismissed. Consequently, miscellaneous petitions, if any, pending, shall stand closed. _____________________ JUSTICE RAJA ELANGO 21.09.
